Disclaimer and regulatory positioning

This page sets out the legal and regulatory framework that applies to all materials published on this website, including the sample dossier, and to any communication initiated through the contact form. Please read it carefully before requesting a sample dossier or submitting an enquiry.

Regulatory status

Elqui Bond Research is not authorised, registered or supervised by the Commission de Surveillance du Secteur Financier (CSSF) or by any other financial supervisory authority. It does not provide investment services or activities within the meaning of Directive 2014/65/EU (MiFID II) - including investment advice, reception and transmission of orders, portfolio management or placing of financial instruments - and it does not hold client assets or client money. Its sole activity is the production and distribution of independent credit research.

1. No investment advice, recommendation or offer

All research, commentary, sample dossiers, and other materials published by Elqui Bond Research are provided strictly for informational purposes and as an independent analytical input. They do not constitute investment advice, a personal recommendation, financial advice, an inducement, or an offer or solicitation to buy, sell, hold, subscribe for, or underwrite any security, financial instrument, or investment product. Elqui Bond Research does not act as a fiduciary, investment adviser, broker, or tax or legal adviser to any recipient. Any investment decision is made solely by the recipient, in light of its own objectives, risk tolerance, mandate, and applicable legal and regulatory requirements.

2. Professional and eligible counterparty audience only (MiFID II)

In accordance with Directive 2014/65/EU on markets in financial instruments (MiFID II), the materials on this website are directed exclusively at persons who are ‘Professional Clients’ or ‘Eligible Counterparties’ within the meaning of MiFID II, and who are resident or operating in the European Union or the European Economic Area. They are not intended for, and must not be relied upon by, retail investors or members of the general public. By accessing the sample dossier or submitting an enquiry, you represent that you fall within one of these categories and that you are accessing the material in a jurisdiction where it is lawful to do so.

3. Not a credit rating

Elqui Bond Research is not a registered credit rating agency under Regulation (EC) No 1060/2009, as amended. The opinions, credit views, and analytical observations expressed in any dossier or publication are independent credit research and narrative commentary. They are not formal credit ratings, rating outlooks, or rating watches, and must not be used, cited, or relied upon as if they were.

4. Independence and regulatory positioning (MAR & MiFID II)

Elqui Bond Research operates as a provider of independent investment research. Under Regulation (EU) No 596/2014 on market abuse (MAR), our research is provided as general information concerning investment strategy and does not amount to a personalized recommendation. We maintain internal policies to identify, manage, and prevent conflicts of interest. The analyst preparing any research has no economic interest in the issuers, securities, banks, or trading desks covered, and does not engage in proprietary trading in the relevant securities. Compensation is not linked to any specific transaction, banking relationship, or issuer mandate.

5. Recipient responsibility and limitation of liability

Recipients are solely responsible for their own investment decisions and for ensuring that any use of our research is consistent with their internal policies, risk appetite, and applicable law. The analysis is based on publicly available information and data believed to be reliable at the time of preparation, but no representation or warranty, express or implied, is made as to its accuracy, completeness, timeliness, or fitness for any particular purpose. Elqui Bond Research accepts no liability for any direct, indirect, consequential, or other loss or damage arising from access to, or use of, this website, any sample dossier, or any communication with the firm.

6. Data sources, use of AI, and methodology

Research is prepared from public filings, prospectuses, financial statements, market data, and other primary sources. Quantitative and large-language-model workflows may be used to widen coverage, improve consistency, and support document review, but all credit judgements are human and traceable to identified sources. We do not guarantee that any particular issuer, security, or market will remain in coverage, nor that any opinion will be updated on a fixed schedule.

7. Contact, sample dossier and intellectual property

The sample dossier is made available for evaluation of our analytical approach and remains the intellectual property of Elqui Bond Research. It may not be reproduced, distributed, redistributed, modified, or used for commercial purposes without prior written consent. Use of the contact form constitutes a request for information and does not create a client, advisory, or contractual relationship. All enquiries are handled in confidence and in accordance with applicable data-protection rules.

8. Investment recommendations regime (MAR Article 20)

Where any material published by Elqui Bond Research qualifies as an ‘investment recommendation’ within the meaning of Article 20 of Regulation (EU) No 596/2014 and Delegated Regulation (EU) 2016/958, it is prepared and presented in accordance with those requirements: facts are clearly distinguished from interpretations, estimates and opinions; sources are identified; valuation methodologies, assumptions and their limitations are described; the identity of the person producing the material and the date and time of completion and dissemination are stated; and any interests or conflicts of interest are disclosed. Such material is general in nature, is addressed to Professional Clients and Eligible Counterparties, and is never a personal recommendation within the meaning of MiFID II. Where research is disseminated publicly on this website rather than under an engagement, it should be treated as a general marketing communication and not as independent research prepared for a specific recipient.

9. Personal data

Personal data submitted through the contact form is processed in accordance with our privacy notice, which sets out the categories of data collected, the purposes and legal bases of processing, retention periods, recipients and the rights available under Regulation (EU) 2016/679 (GDPR).
